I'm on another board that covers WA and OR so I have seen this debate many times on that board. Their laws are pretty much the same.

The last thread was about a tuna trip. Folks down there that target albicore far offshore and guys are fueling up with $700 in fuel, 500lbs of ice in preparation for a 50 mile run out ot the tuna grounds...its a big production. Long story short, upon the return from one such trip, enforcement witnessed a buddy hand over $150 cash to the boat owner/opperator of a "pleasure craft"...he got pinched under an identical law.

Seems extreme to me and most people involved in that thread. Pretty much everyone agreed keep those arrangements off the water and away from the trip and you should be fine.

PS - the guy in the CL ad is not functioning like a typical boat owner taking a budy fishing so I think everything FG said is appropriate to that individual. WB, your may not function like the CL guy but I know there have been others caught on the wrong side of that law so just be careful!

On a side note...one thing that cuaght my attention was the term "for profit"...a share of the gas certainly can't be seen as "for profit" but I wouldn't want to be put in a situation where I had to justify things to the courts! ;)

I agree. If taking gas money was illegal we would have heard about a local getting pinched... Tc and dfo are not interested in my boat gas and I'm done with this topic.

I don't have a dog in this fight, but was involved in a civil suit where a group of teens were involved in a car accident after a friday nite party- in testimony it was stated that all the passengers threw in gas money as was their accepted practise. The court ruled that due to the small transfer of funds among friends that the onus of proof fell from "GROSS NEGLIGENCE" down to "Simple Negligence" which was much easier to prove in this case- I guess fishing guide said it best when he mentioned how people testify when it comes to money and how tight thefriendships are. just a thought. Personally I think some gas/beer money should be expected after the large outlay for the boat and equipment.

i am a guest on a friends boat, i buy the fuel,if anyone has a beef id just say i paid for the fuel but had nowhere to combust it so i am combusting it in this guys boat motor...lol.. :lol:....the guy is acting like a guide plain and simple...no fancy riggers or insurances...lmao...gimme a break ,pretty cut and dry..he also uses the word charge....compensation would be a better word... holmes*

geeze i take people out all the time,,so what, i'm not a guide,,,,,and i have fun,and so do my friends,,,,rediculas,,,,i accept gas money,beer whatever,,,maybe the guides should concentrate on thier own affairs not everyone elses,,not a crime,,,and these people would never get a chance to fish due to guide costs,,so it is not like they are being shorted a customer,,hay and kids free,,,big ocean and i'm sure there is room,,,,,,t out

ya about the non insured guiding,give it a rest.it is not a formal business with formal advertising.a person can make any personal arrangements that they want with another consenting adult.the liability issue,also between parties involved.the only time this should be an issue would be if you were formally advertising and offering a public service,misleading people into thinking that you are fullyserviced and insured.otherwise to each his own and there is nothing we can do about it.if you are going to guide under the table,don't publicly advertise the fact for it causes an uproar.if you are any good you don't need any more than word of mouth.SS out

This topic is no different than say, insuring your car in your spouses name and labbling them the principle driver for a disscount in insurance.. Its done all the time and many save money. Its never a problem untill some thing goes wrong, say your in an accident and seriously innjured or some one else is , now you have a problem.. like when I.C.B.C. says your insurance in void.. Or you insure your car for pleasure only and get in an accident driving to work ,, when I.C.B.C disscouvers that you where using car to go to work and back more than the legal allowed "your done".
Its simple do what you want but when your losing your boat because you choose to ignore previous advice and warnings then be the man you are and suck it up, because lots of things are easy to do , untill you get nailed and are standing before justice looking dazed and confused.
